DDA: Pre-2011 GPAs also valid for mutation

General Power of Attorney (GPA) along with an Agreement to Sell (ATS) document will now be considered valid prerequisites for property conversion from leasehold to freehold. The decision was made in a meeting of senior DDA officials with the chairperson, Najeeb Jung. Sale of properties through GPA was banned in 2011.

Official said the decision to allow property conversions through GPA was taken after soliciting opinion of the Solicitor General of India. “The Competent Authority in DDA, after taking the opinion of the Solicitor General of India, has decided to allow such conversion subject to producing documents authenticating that the transaction is genuine,” the spokesperson said. “The documents will be verified at the time of processing of conversion application and will be subject to production of required documents.”

Apex Court had banned the sale of properties through GPA in its ruling in the case of of Suraj Lamp & Industries Private Limited versus the State of Haryana. With the result that only those who originally owned a property could get a conveyance deed from DDA after converting it from leasehold to freehold. However, in many cases, properties were sold and resold many times over on GPA without getting the property title converted.
