Don’t cut utilities without flat deeds, GDA tells Shipra

Residents of five multistorey residential complexes in Indirapuram and Kaushambi have been saved from the withdrawal of several facilities the construction company has been providing them since the time the apartments were sold.

The Ghaziabad Development Authority (GDA) has refused to provide the Shipra Group permission to withdraw the facilities, "because the residents of these complexes have not been provided deeds of declaration by the builder, as required under the Uttar Pradesh Apartments Act of 2010."

The facilities the builder sought permission to discontinue would include power backup, plumbing and water supply, sanitation, security and more. And, the complexes that would be affected are Shipra Neo in Vaibhav Khand, Shipra Sun Tower in Sun City, Regalia Heights in Sun City Phase I, Shipra Royal Tower in Vaibhav Khand and Shipra Azure in Kaushambi.

Revealing this, Sri Prakash Gupta, GDA officer on special duty, told TOI that the builder has been providing these facilities ever since these flats were sold to the buyers. "But the apartment owners have not been provided DoDs, which is mandatory under the Act. The DoDs which have to be provided to all the buyers include complete details about the architecture, plans, encumbrances if any, the approvals procured and all other details, including the use of the common area and the facilities provided by the builder".

Unless, there is a DoD, the GDA and the apartment owner have no information about what services the owners are to be provided and for how long. "In such circumstances, how can the builder convince the GDA that the builder had the right to stop providing any amenities at any particular period," Gupta asked.

Meanwhile, Alok Kumar of the Federation of Apartment Owners'Associations, explained that "even elections to the RWAs cannot be held in the absence of complete details about complexes, because the number of votes a member has depends on the official size of the apartments."
