Register flats only after papers in place: Owners

The Federation of Apartment Owners Associations (FedAoA) of Ghaziabad has urged the district administration to allow registration of flats in the city only after builders furnish completion certificates and deeds of declaration of their respective projects, along with stamp papers.

The federation has made this demand after it emerged that a number of flats in projects, which were never sanctioned in the original layout plans, were getting legalized following completion of registration. A letter in this regard has also been shot to the office of the assistant commissioner in the department of stamps and registrations.

“Apart from legalizing unsanctioned flats, registrations without certified copies of these documents are also leading to financial losses to the tune of several crores of rupees to the exchequer,” said federation president Alok Kumar.

The federation has also demanded that the stamp department make it mandatory for sellers of individual flats to third parties, to provide NOCs from their respective Apartment Owners Association, after paying 0.5 per cent of the transfer fee before registration of such sub-leases. The UP Apartment Act, 2010, mandates payment of this amount to associations during sub-leasing of flats to third parties.

The federation has also asked the stamp department to fix a particular timeframe for all flat owners – who have registered their properties after the enforcement of the UP Apartment Act – to submit their completion certificates and deeds of declaration.

This move, as per the association, would help raise revenue for the government by pinpointing projects where compounding of unauthorized extensions has not been carried out till date.
