HC notice to govt for multiple plot allotments

Taking up a petition of several persons who had purchased properties from those who obtained multiple plots by furnishing false affidavits in areas developed by Haryana Urban Development Authority (HUDA), the Punjab and Haryana high court issued notice to the state government to file its reply.

According to petitioners, they had purchased plots from the original allottees as per HUDA rules and at market price.

The petitioners submitted that their rights would be prejudiced if the process of cancellation of the allotment of these plots was initiated by HUDA in the near future. They told the HC that they should not be punished for the fault of those who managed to get multiple plots on the basis of false affidavits. The petitioners also sought directions to restrain HUDA from canceling their plots.

Hearing the pleas, the high court clubbed all petitions with the main case and fixed it for further hearing on January 15. Issuing a notice, the court also asked HUDA and the state government to file their replies on the contentions raised by the petitioners.

The matter had reached the HC after a serving colonel, who was booked for getting several plots in HUDA sectors through false affidavits, had approached the court seeking a stay on his arrest. Thereafter, the court had taken cognizance of allotment of multiple plots in favour of several persons in contravention of the HUDA rules.

Following HC intervention, HUDA recommended registration of an FIR against all those persons who were allotted more than one plot under the reserved defence category quota. Till date, more than 400 FIRs have been registered by the state police on recommendations of HUDA against the persons who procured multiple plots. The list of persons who have been booked for obtaining multiple plots includes politicians, senior bureaucrats, defence personnel among others.

The HC has already made it clear that the court would not spare anyone, however prominent or mighty that person may be, if found faulty in the case.
